1. Introduction
Welcome to UniversalDataCommons ("we," "us," or "our"). The use of our yacht rental services and our website hosted at universaldatacommons.xyz (termed as the "Service") is governed by these Terms & Conditions ("Terms"). By choosing to rent a yacht or by using our Service, you consent to these Terms. If you don't accept any part of the terms, accessing the Service is not permitted for you.
2. Service Overview
UniversalDataCommons offers a range of upscale yacht rental services, including but not limited to:
- Renting yachts on a daily basis
- Evening cruises
- Corporate getaways
- Exclusive events
- Extended yacht charters
Service provision is contingent on availability and climate conditions. We hold the right to alter or cease services without prior notice.
3. Reservation and Booking
3.1 Reservation Procedure
- Be a minimum age of 18 years
- Provide truthful and comprehensive details
- Make a deposit as stipulated in your reservation confirmation
- Adhere to these Terms & Conditions
3.2 Reservation Confirmation
We only acknowledge booking confirmations after we have received the payment and issued a written confirmation. We have the discretion to decline service to any individual.
3.3 Charter Availability
Our yacht charters are subject to both availability of the vessels and appropriate weather conditions. We will do our best to comply with your desired scheduling.
4. Payment Information
4.1 Costs
All mentioned rates are in € and include relevant taxes unless specified otherwise. Rates are amenable to changes without prior announcement.
4.2 Payment Schedule
- Initial deposit: 50% of the total cost of the charter, due upon reservation
- Remaining amount: To be paid 48 hours prior to the departure of the yacht
- Incidental expenses (if incurred): Payable upon conclusion of the charter
4.3 Accepted Forms of Payment
We accept significant credit cards, direct bank transactions, and certified bank drafts. Payments are processed using safe, encoded procedures.
5. Cancellation and Reimbursement Policy
5.1 Client Cancellations
- With over 72 hours notice prior to departure: Full reimbursement minus handling fees
- Between 24 to 72 hours notice before departure: 50% refund
- With less than 24 hours notice before departure: No reimbursement
5.2 Cancellations Due to Weather
In the event that our captain considers weather conditions unsafe for sailing, we will try to:
- Reschedule your reservation for a later date, with no added costs
- Offer a complete reimbursement if rescheduling isn't feasible
5.3 Equipment Failure
If your chartered vessel encounters a mechanical issue, we will endeavor to offer a suitable substitute. Should an alternative not be available, a complete refund will be issued.
6. Safety and Behavior
6.1 Safety Precautions
- Adhere to all directives issued by the crew
- Utilize the provided safety gear when necessary
- Disclose any medical conditions that may impact your safety
- Stay within the permitted areas onboard the vessel
6.2 Forbidden Items
The following are not allowed on board:
- Containers made of glass
- Illegal substances
- Weapons or firearms
- Pets (unless with prior authorization)
6.3 Conduct
We expect all passengers to behave respectfully. Should passenger conduct jeopardize safety or disturb others' experiences, we reserve the right to cease the charter prematurely with no refund.
7. Insurance and Accountability
7.1 Our Responsibility
Our obligation is limited to the amount you have paid for your charter. We do not accept liability for:
- Personal injuries caused by the passenger's own carelessness
- Damage or loss of personal belongings
- Indirect or punitive damages, or any consequence that may result
- Delays due to weather or other events that are out of our control
7.2 Coverage by Insurance
Our vessels and operations are safeguarded by full maritime insurance. However, passengers should have their own travel and personal insurance.
7.3 Acknowledgement of Inherent Risk
By engaging in our yacht services, you recognize that inherent risks are involved in marine activities and accept personal responsibility for your safety.
8. Adjusting Itineraries
We have the authority to alter travel routes, schedules, or other itinerary elements due to meteorological conditions, safety, or other operational necessities. We will make all reasonable attempts to ensure the provided experience is equivalent to the planned one.
9. Force Majeure
Strikes, natural calamities, laws, harbor closures, and mechanical issues are among the events beyond our control for which we cannot be held liable for any disruptions, postponements, or alterations that result.
10. Personal Data and Privacy
Your private information is managed in line with our Privacy Policy. By making use of our Service, you acknowledge and agree to our collection and utilization of your data as described in the aforementioned Policy.
11. Proprietary Content
All materials found on our website, such as writings, pictures, logos, and icons, are shielded under copyright and trademark laws. Unauthorized reproduction, distribution, or the creation of derivative works is prohibited without our explicit consent.
12. Jurisdiction
These Terms are subject to the laws in force in Spain. Any disputes arising shall be addressed in the courts positioned in Barcelona, Spain.
13. Amendments to Terms
Alterations to these Terms may be carried out by us at any moment. Updates will be published on our website with a corresponding change to the revision date. Your ongoing use of our Service will constitute acceptance of the new Terms.
